Spin the Wheel End User License Agreement

This End User License Agreement ("EULA") is a legal agreement between you and Orionity ("Orionity", "we", "us", or "our") governing your download, installation, access to, and use of the Spin the Wheel mobile application, including any updates, related content, and support materials we provide with it (collectively, the "App").

By downloading, installing, accessing, or using the App, you agree to be bound by this EULA. If you do not agree, do not download, install, access, or use the App.

If you obtained the App through the Apple App Store, Google Play, or another third-party distribution platform, you also agree to comply with that platform’s applicable terms, rules, and policies. This EULA applies between you and Orionity, not between you and the platform provider, except where the platform’s mandatory terms control.

Subject to your compliance with this EULA, Orionity grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App for your personal, non-commercial, lawful use on devices you own or control, solely as permitted by this EULA and any applicable app marketplace usage rules.

This license does not transfer any ownership rights in the App. Orionity and its licensors retain all rights, title, and interest in and to the App, including all intellectual property rights not expressly granted to you under this EULA.

You may not, except as expressly permitted by applicable law, copy, reproduce, distribute, publicly display, publicly perform, modify, adapt, translate, reverse engineer, decompile, disassemble, attempt to derive source code from, create derivative works of, sell, rent, lease, lend, sublicense, or otherwise exploit the App or any part of it.

You may not use the App in a way that violates applicable law, infringes the rights of others, interferes with the App’s operation, attempts unauthorized access to systems or data, or circumvents technical or contractual restrictions that apply to the App.

The App may allow you to create, store, edit, or manage names, lists, entries, weights, labels, and similar content that you provide ("User Content"). You retain any rights you may have in your User Content.

You are solely responsible for your User Content and for your use of the App. You represent and warrant that your User Content, and your use of the App, will not violate applicable law, third-party rights, or this EULA.

In the current version of the App, core User Content is stored locally on your device. Orionity does not claim ownership of User Content that remains solely on your device.

The App may offer optional paid subscriptions or in-app purchases that unlock premium features. Available plans, pricing, billing periods, trial offers, and included features will be presented to you in the App before purchase.

If you purchase a subscription through Apple, Google, or another platform provider, billing is handled by that provider, not by Orionity directly. Your purchase is subject to the provider’s payment terms, billing processes, and refund rules.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period, or as otherwise stated by the platform provider. You may manage or cancel your subscription through your account settings with the platform provider from which you purchased the subscription.

Except where required by applicable law or the platform provider’s rules, payments are non-refundable and non-transferable. Orionity may change subscription offerings or pricing for future billing periods, subject to applicable law and platform rules.

Orionity may update, modify, improve, suspend, remove, or discontinue all or any part of the App at any time, with or without notice, to the extent permitted by law.

We may release updates, bug fixes, patches, or other modifications. Depending on your device, platform, or settings, you may need to install updates to continue using all or part of the App.

Certain features may depend on third-party services, app marketplace functionality, device compatibility, internet access, or operating system support, each of which may change independently of Orionity.

The App may contain links to, integrate with, or rely on third-party services, websites, software, or infrastructure. Orionity does not control and is not responsible for third-party services or their content, availability, policies, or practices.

If you obtained the App through Apple’s App Store, you acknowledge that Apple has no obligation to provide maintenance or support services for the App except as required by applicable law. To the maximum extent permitted by law, Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.

Your use of the App is also governed by the Spin the Wheel Privacy Policy, which describes how Orionity processes information in connection with the App. The Privacy Policy is incorporated into this EULA by reference.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

ORIONITY DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, AVAILABILITY, OR THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY ORIONITY OR ITS AUTHORIZED REPRESENTATIVES CREATES ANY WARRANTY.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ORIONITY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, OR USE, ARISING OUT OF OR RELATED TO THE APP OR THIS EULA, EVEN IF ORIONITY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ORIONITY’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE APP OR THIS EULA WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ORIONITY OR THROUGH THE APP FOR THE APP OR RELATED SUBSCRIPTIONS IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS (USD $50).

Nothing in this EULA excludes or limits liability that cannot be excluded or limited under applicable law. Your statutory consumer rights remain unaffected.

This EULA remains effective until terminated by you or Orionity.

You may terminate this EULA at any time by discontinuing use of the App and deleting or uninstalling all copies in your possession or control.

Orionity may suspend or terminate your rights under this EULA if you breach this EULA, violate applicable law, or use the App in a manner that could create liability, harm, or legal risk for Orionity, other users, or third parties.

Upon termination, the rights granted to you under this EULA will immediately cease, and you must stop using the App.

To the extent permitted by applicable law, this EULA and any dispute, claim, or controversy arising out of or relating to it or the App will be governed by the laws of the Republic of Serbia, without regard to conflict of law principles.

If you are a consumer residing in a jurisdiction that grants you the protection of mandatory local consumer laws, nothing in this EULA deprives you of the protections of those mandatory laws.

Orionity may update this EULA from time to time to reflect legal, operational, or product changes. When we do, we will publish the updated version at this URL and revise the effective date above.

Your continued use of the App after the updated EULA becomes effective constitutes your acceptance of the updated EULA, to the extent permitted by applicable law.
